Customer’s Acknowledgment
These Terms and Conditions apply to a customer from the instant he/she purchases the SIM. Customer agrees and accepts all the Terms and Conditions including these and therefore the ones available on Operator’s website unconditionally by providing thumb/finger impression for verification from NADRA. Furthermore, the Customer acknowledges and undertakes that he has allowed the Operator to use his biometric information for verification from NADRA, being a legal obligation and without verification of the SIM can’t be activated. The operator shall have the right to reject activation or disconnect any connection in the name of the customer who disagrees with those Terms and Conditions or violate(s) any of the above-mentioned laws including but not restricted to the Fair Usage Policy of the Operator.
Charges: Charges as payable by the customer, whether beforehand or after availing the Services, shall include but not be limited to:
Tariffs, costs, rates, installation charges, line rent, equipment price, connection charge SIM card price, Visitor Location Register (VLR), verification charges, and charges for value-added services and other charges, fees, other payments as defined and brought into Customer’s notice from time to time subject to the approval of the Authority (if so required following applicable laws).
Taxes, duties, and rates which are or may become viable following applicable laws, rules, and regulations. The operator will determine an initial appropriate credit limit for the customer.
Default: Operator are going to be entitled to disconnect the customer’s service on
- Failure to Pay Invoices Within Due Time
- Exceeding Credit Limit
Misuse of Services: Violation of Terms and Conditions and Fair Usage Policy in compliance with the provisions of the Telecom Consumers Protection Regulations, and therefore the Production from Spam, Unsolicited, Fraudulent and Obnoxious Communication Regulations 2009 and other laws for the nonce
Non-Usage: Just in case the customer remains inactive for the amount of 180 days; the operator reserves the proper to disconnect and re-issue the MSISDN to the other customer and therefore the customer shall haven’t any option for recourse. The customer can, however, retain the subscription by informing the operator in writing, fax, email, etc. To hold the subscription for any specific period on payment of some charges (if any).
Liabilities: The person shall be personally liable for all calls, SMS and MMS made up of the customer SIM/terminal equipment and shall neither use, send nor permit the other person to use the system and repair for sending inter alia unsolicited, obnoxious, misleading, indecent, obscene, or false messages, calls or communications; or the persistent making of calls which can annoy a person. The Customer shall duly keep himself/herself informed of all the wants concerning the use of Connection and shall be held solely responsible for all illegal acts and omissions. Just in case of loss of the SIM card, the customer shall immediately but not later than 24 hours inform and request the respective Operator to inactivate the SIM card, failing which, the Customer shall not be released from criminal liability, if any, arising due to use of SIM card in any criminal activity. The customer shall not enjoy the generation of spam and just in case of customer found to enjoys any such activity, the outgoing SMS facility of his/her MSISDN are going to be blocked initially instance and on the subsequent activity, the subscription is going to be permanently blocked.
Variation: Operator may vary, increase or decrease the fees, tariffs, rates and therefore the charges, etc. And notify the Customer subject to the agreement of the Authority (if so required) of such variation in the manner prescribed under the prevalent law at the time.
Force Majeure: Any circumstance which is beyond the control of the operator, including without limitation to acts of God, insurrection of civil disorder, war or military operations, national or local emergency, actor omissions of state, or any competent authority, industrial disputes of any kind, fire, lightning, explosion, flood, the weather of outstanding severity, acts or Omissions of person for whom the operator isn’t responsible, including Jammers and other frequency interference by a third party, strikes, lockouts, and interruption of the services for Maintenance of the systems which incorporates physical features and atmospheric conditions, Operator shall not be in charge of that period to a customer regarding any service as per these Terms and Conditions.
Arbitration: If any difference or dispute arises between the parties which can’t be settled amicably; the matter is going to be mentioned authority which can investigate and adjudicate on the complaint by the act, the principles made thereunder and Operator’s telecom license conditions and should take action accordingly.
Miscellaneous: All information contained in operator’s promotion, advertisements, and publicity campaigns, including the terms and conditions available on Operator’s website shall apply once Customer subscribes to any such service and shall be deemed to be a part of any agreement between the customer and operator. The customer has the right to say refund to security at the time of disconnection of services after adjustment of pending dues. All customer information shall remain confidential for all purposes, unless required to be disclosed to the govt department or agencies, or otherwise agreed to the disclosed with the consent of the customer.
These Terms and Conditions shall be subject to the requirements of the Act, License conditions, Rules, Regulations, and directions issued by the PTA from time to time.
